<p>In many cases, the answer is yes, but there may be special conditions attached, especially if the offense involved a minor. Before making travel plans, it helps to understand the law and the potential problems that can arise along the way.</p>



<h2 class="wp-block-heading" id="h-can-a-sex-offender-get-a-passport-here-s-what-federal-law-says">Can a Sex Offender Get a Passport? Here’s What Federal Law Says</h2>



<p>According to<a href="https://www.law.cornell.edu/uscode/text/22/212b"> 22 U.S.C. § 212b</a>, the Secretary of State can’t issue a passport to a covered sex offender unless it contains a unique identifier. It also allows the government to revoke a passport that was previously issued without that special stamp.</p>



<p>The same law says a passport can later be reissued without the identifier if the person reapplies and the Angel Watch Center (AWC) determines the person is no longer required to register.</p>



<p>The State Department requires covered sex offenders to self-identify when applying, send in any passport book they already have without the identifier, send in any valid passport card, and include a signed statement saying they believe they’re covered under<a href="https://www.congress.gov/bill/114th-congress/house-bill/515/text"> International Megan’s Law</a>.</p>



<p>So yes, getting a passport may be possible for a sex offender. However, for many applicants, it won’t be a standard, clean passport with no extra notation.</p>



<p>One more thing you should know: covered sex offenders can’t receive a passport card. That’s because there isn’t enough space on the card to include the required identifier alongside the standard information.</p>



<h3 class="wp-block-heading" id="h-what-is-the-passport-marker">What Is the Passport Marker?</h3>



<p>On the inside of the passport book, there’s a printed statement that reads: “The bearer was convicted of a sex offense against a minor, and is a covered sex offender pursuant to 22 USC 212b(c)(1).”</p>



<p>This marker flags the passport holder in connection with a qualifying sex offense and federal passport law. That’s why people sometimes say<a href="https://checkpeople.com/blog/sex-offender-tiers/"> sex offenders</a> can’t get a “normal” passport.</p>



<h3 class="wp-block-heading" id="h-who-counts-as-a-covered-sex-offender">Who Counts as a Covered Sex Offender?</h3>



<p>The statute defines a covered sex offender as someone who’s convicted of a sex offense against a minor that requires registration under the sex offender registration program of any jurisdiction.</p>



<p>This distinction is important. If the offense didn’t involve a minor, the special passport identifier under International Megan’s Law may not apply. However, registration duties, travel notice rules, and other restrictions may still apply depending on the person’s case and jurisdiction.</p>



<p>In simple words, not every person with any sex-related conviction will have the exact same passport situation. A lot depends on the offense, whether a minor was involved, whether the person is still required to register, and whether the AWC has determined the person is covered for passport-marking purposes.</p>

<p>No, having the marker on the passport doesn’t mean the person can’t leave the country. The law was designed in part to notify foreign governments about covered offenders traveling internationally.</p>



<p>The problem is usually not leaving the U.S., but gaining entry into another country.</p>



<h3 class="wp-block-heading" id="h-can-a-foreign-country-deny-entry-to-a-covered-sex-offender">Can a Foreign Country Deny Entry to a Covered Sex Offender?</h3>



<p>Yes, having a passport doesn’t guarantee entry into another country.&nbsp; While the U.S. doesn’t stop a registered sex offender from leaving, other countries make their own decisions about who they let in. Registered sex offenders can usually travel to countries that don’t do a<a href="https://checkpeople.com/blog/how-long-does-a-criminal-background-check-take/"> criminal background check</a> before allowing entry. In many cases, all a country asks for is a valid U.S. passport.</p>



<p>That said, the identifier in the passport is visible to every immigration officer who opens it. Plus, the AWC may have already notified the destination country before the person even arrives. This might affect the foreign immigration officers’ decision to grant entry.</p>



<p>Some countries have strict policies against letting in registered sex offenders and deny entry after reviewing advance information, while others may turn a traveler away on arrival. Sometimes, the outcome can depend entirely on the officer at the border.</p>

<p>If you fail to notify authorities of your intent to travel internationally correctly, you could be charged with a crime that carries up to ten years in federal prison.</p>



<h2 class="wp-block-heading" id="h-what-happens-when-re-entering-the-us">What Happens When Re-Entering the US?</h2>



<p>Registered offenders can legally re-enter the country. However, they should be prepared for intense screening and questioning by customs agents upon re-entry, which often results in long delays. This can be especially stressful after a long international trip, but it’s part of the reality of traveling as a registered sex offender.</p>



<p>The best advice is to document everything, including every notification you made, every form you filed, and every response you received.</p>
